Notice of Proposed Special Education Services
There are changes in the information that must be included on the Notice of Proposed Special Education Services. We are working to have the changes put on Campus but a form if not yet available on Campus to address the changes. Until the form is available on Campus, create a hard copy of the form from the attachment to this email and address the items on the Notice.

All of the following items must be addressed:

1. Description of action: (See attached IEP).

2. Explanation of why the District proposes action:

a. Write a statement that describes the student’s problems that require special education services.

Example:

“Due to Student’s days/difficulties in (e.g., writing, reading, behavior, speech, etc.) outlined in the IEP, special education services are necessary.

3. Description of the options considered by the District and reasons why those options were rejected:

a. Write a statement that describes other federal settings that are options and why the other setting(s) is not appropriate for the student.

Examples:

Student receiving federal setting 1 service: “Student is making progress receiving federal setting 1 level of service. A more intense level of service would be too restrictive.”

Student receiving federal setting 2 service: “Student was not making progress on behavior goals and objectives with federal setting 1 level of service so it is necessary to increase service to a federal setting 2.”

Student receiving federal setting 3 service: “Student requires an alternative curriculum and the severity of the disability requires federal setting 3 services. Student’s behavior is too disruptive and unsafe to receive service in federal setting 1 or 2.”

4. Describe each evaluation, test, record, or report used as a basis for action:

a. When an evaluation/reevaluation has been completed just indicate:
“See attached ESR”.

b. For annual IEP write a statement that indicates the ongoing measures
used as the basis for the decision.

Example:

“This proposed action is based on student observation, work/language samples, staff reports, progress reports on IEP goals and objectives, etc.”

5. Description of any other factors that are relevant to the proposed action or refusal.

Describe any other relevant factors.
