Discontinuation of Special Education Services Note: The Notice of Procedural Safeguards: Parental Rights for Special Education must accompany all due process forms. Discontinuation of a Special Education Service (not discontinuation of the IEP) 1. Send out a “Notice of Educational Reevaluation” to the parent that is marked “c” to indicate that “existing data” will be used and no new testing will be completed. 2. Report the “existing data” on an ESR that supports no additional special education needs for the student in the service area (e.g., OT, SW, S/L, PT, etc.) 3. Hold an IEP team meeting within 30 school days. Create a new IEP without the service being terminated. 4. Complete the 5 additional areas of the “Notice of Special Education Service” and check the box next to “Your child’s IEP has been changed as noted”. Send the Notice and the IEP to the parent. Discontinuation of all Special Education Services (discontinuation of an IEP) 1. Send out a “Notice of Educational Reevaluation” to the parent that is marked “c” to indicate that “existing data” will be used and no new testing will be completed. Be sure to address all components related to eligibility on the Notice. 2. Report the “existing data” on an ESR that addresses all the components of eligibility. Use the template on Campus in the disability area in the “Summary and Interpretation” section of the ESR. 3. Hold an IEP team meeting within 30 school days. Report the results indicated that the no longer has special education needs. 4. Complete the 5 additional areas of the “Notice of Special Education Service” and check the third box on the form /indicating that all special education services will be discontinued. 5. Enter an end date for all special education services on the service line(s) of the IEP. Create a new IEP record the start date and end date as the same date: the date that the Signed the Notice or 14 calendar days (with 2 documented attempts to obtain a signature). In the MARSS area, change the status code to “7” indicating that the IEP is being discontinued. Leave the primary disability and the federal setting on the “IEP”. |
